Encore Reclamation’s aim is that every customer will be happy with goods purchased from us. These terms and conditions of sale are designed to prevent misunderstanding. You should familiarise yourself with these terms and conditions prior to doing business with Encore Reclamation. These conditions do not preclude your legal rights.
Making a Purchase
If you wish to make a purchase from Encore Reclamation you may do so online using credit and debit cards. Alternatively you can contact us directly and make payment by bank transfer.
Advice or Recommendation
Any advice or recommendation given by Encore Reclamation or its employees to the Buyer either verbal or written, is followed or acted upon entirely at the Buyer’s own risk and accordingly Encore Reclamation shall not be liable for any such advice or recommendation.
Transmission of Viruses
Users use this website at their own risk. Whilst precautions have been made to prevent transmission of viruses, we are not responsible for any damage caused as a result of a Virus.
Prices
The prices payable for the products that you order are clearly set out on the Encore Reclamation web site. For more complex or custom purchases, such as large amounts of reclaimed flooring you may need to call for a quote. Advertised prices do not include the delivery charge.
Due to the dynamic nature of our business, sometimes mistakes can be made when adding prices to our products and for this reason we will not be held to any price displayed on this website.
Contract
The steps required to create the contract between the customer and Encore Reclamation are as follows:
You place the order for your products on the Encore Reclamation website by pressing the “confirm order” button at the end of the checkout process.
We will send you an order acknowledgement email containing details of the product(s) you have ordered. This is not an order confirmation or order acceptance from www. encorereclamation.co.uk.
Order acceptance and the completion of the contract between yourself and us will take place on the despatch to you of the product(s) ordered, unless we have notified you that we do not accept your order, or you have cancelled it.
We reserve the right not to fulfil your order for any reason, including but not limited to, product pricing and availability. In the event of any of these circumstances we will contact you to either amend or cancel your order or offer a full refund. Encore Reclamation will not be liable for any failure to perform, or delay in performance of, any of our obligations under these terms that is caused by events outside our reasonable control (Force Majeure Event).
Handling Delivery
We send your order as soon as possible, usually the next working day. If we cannot despatch within 3 working days we will inform you via e-mail of an expected despatch date. If for any reason beyond our reasonable control, we are unable to supply you with a particular item, we will notify you as soon as possible offering an alternative product/delivery date, or a full refund.
Delivery Options
The delivery charges vary subject to the charges that our carrier will charge us to deliver your purchase to you.
Once parcels are with the carrier, they are out of our control and we cannot be held responsible for any consequent delays. If nobody is at the given address when the carrier delivers, they will leave a card for you to phone to arrange an alternative delivery day. Please respond to this immediately. If a parcel is returned to us undelivered, carriers impose a return charge which we regrettably have to pass on to the purchaser if it becomes clear that the address details given were not correct.
If possible please check the goods on receipt and inform us of any obvious damage following inspection. If there is any obvious cosmetic external damage to the goods at the time of delivery we ask you to note this on the delivery terminal/paperwork or refuse the delivery. Risk to the goods shall pass to the buyer upon delivery or collection. We can despatch to another address if you are not sure you will be in to receive a parcel. Alternatively, you may phone us for costing on a timed delivery.
Product dimensions, weights and colours
It is important to note that the product dimensions do not include any protruding features such as handles or fixings etc.
Whilst we try to be as accurate as possible, all sizes, weights and measurements quoted on this website are approximate and we shall not be held responsible for any errors in the dimensions displayed on our website.
Images of all the products shown on this website are for illustrative purposes only. We have made every effort to display all product colours accurately but we cannot guarantee that the image displayed on your computer monitor will accurately reflect the true colour or tone of the product delivered to you.
Product Sample
Where the Buyer has been shown or sent a sample Encore Reclamation does not undertake that the bulk shall correspond with the sample in colour, exact dimensions or quality. It is suggested that the Buyer views and examines the bulk stock prior to ordering.
Product condition
Whilst we try to be as accurate as possible with our product descriptions it has to be remembered that architectural salvage is, by nature, aged, and therefore will more than often have marks and imperfections, commensurate with age. Many items are made from natural materials that contain marks and blemishes due to the nature of that material, so it is important that you study the photographs of a product before you purchase it, as you will incur the cost of shipping if you feel the need to return a product to us.
Credit Card Security
We take online payments via PayPal and and a secure offsite payment gateway, both of which are secure but we cannot be held responsible for any breaches of security that are out of our control.
Returns Policy
Please inspect goods on receipt. If you wish to cancel your order you will receive a full refund. Where the goods have been delivered to you, you must inform us of your decision to cancel within 10 days from the date of delivery providing the goods are returned in the condition in which they were sold, with all packaging. Under the terms of the distance selling directive you as the customer have a duty of care for the product whilst it is in your possession. Therefore we reserve the right to refuse cancellation, or charge you for any damage that has occurred whilst the goods have been in your possession. Postage and packing costs cannot be refunded and the cost of the return postage must be paid for by the customer. This does not affect your statutory rights. Exchanges
Customer to pay additional postage costs.
Special Orders
We do not offer refunds or exchanges if items have been made specially to order; therefore bespoke items are not refundable. Encore Reclamation shall take a 50% deposit where goods are being specially made for the buyer to an agreed specification or where goods are to be reserved prior to collection or delivery. The seller will retain the deposit if the buyer in any way changes agreements made.
Faulty Products
In the unlikely event you receive a faulty or damaged product, please inform us immediately for a replacement.
Payment
The Buyer shall pay the full price of the goods before they are delivered or collected. If the Buyer fails to make payment at the due time then without prejudice to any other right or remedy available to Encore Reclamation, the Encore Reclamation shall be entitled to:
Refuse to part with the goods
Cancel any contract or further deliveries
Goods shall remain the absolute property of the Encore Reclamation as legal and equitable owner until Encore Reclamation has received in cash or cleared funds payment in full for all amounts owing to them.
Where by express agreement with the Encore Reclamation, the Buyer returns goods to stock, a minimum handling charge of 20% of the invoice value plus carriage costs incurred may be deducted from the amount to be credited. Encore Reclamation’s liability shall not exceed the invoice price of the goods concerned, all liability for consequential loss is expressly excluded.
Infested Timber
Encore Reclamation will not knowingly sell any infested timber. Timber sold is normally untreated and entirely at the Buyers own risk and accordingly Encore Reclamation shall not be liable for any infestation problems thought to arise from such timber. For peace of mind the buyer should consider treating timber.
International Orders
We are happy to post anywhere in the world. Outside the EU local import and customs charges may apply, these are the responsibility of the purchaser. When we have established the best way to ship your items we will contact you and then process the order.
